Los desahucios, los jueces y la idea del Derecho

Abstract

En El País de este domingo (14 de abril) puede leerse un titular, en la portada, que dice así: “Los jueces se coordinan para frenar desahucios hasta que se reforme la ley. Los magistrados paralizan procesos ante cláusulas consideradas abusivas”. Y hace aproximadamente un mes, comentando la sentencia del Tribunal de Justicia de la Unión Europea que ha ocasionado esta nueva actitud por parte de los jueces, el presidente del Tribunal Superior de Justicia del País Vasco había hecho la siguiente declaración: “Hoy [la sentencia se dictó el 14 de marzo] podemos decir que los jueces [españoles] no somos los cobradores del frac; juzgar no es cobrar sino resolver cuestiones controvertidas y la actual regulación de los procedimientos hipotecarios no permitía al juez desarrollar esta labor”.
