Consolidación del arbitraje como método de solución de controversias hermenéuticas en el ámbito internacional tributario

Abstract

Constatada la creciente importancia y proyección de futuro del Derecho Internacional Tributario en nuestros días, el presente trabajo aborda la problemática inherente a la solución de conflictos tributarios en el ámbito convencional, con particular referencia al procedimiento amistoso como método tradicional de dirimir las controversias interpretativas en el seno de los convenios para evitar la doble imposición internacional. Partiendo de la insuficiencia de la vía amistosa a tales efectos, la autora ofrece mecanismos alternativos -con base en las aportaciones de la doctrina comparada y de distintos foros internacionales-, concluyendo la mayor adecuación del sistema arbitral, tanto frente a las propuestas de naturaleza consultiva, cuanto respecto a la posibilidad del recurso ante alguno de los Tribunales internacionales ya existentes. Sin duda, la original y novedosa construcción de arbitraje internacional tributario que en estas líneas se propone constituye un valor añadido del presente trabajo.

Given the growing importance of International Tax Law nowadays, and its likely growth in the future, this work addresses the difficulties inherent in tax dispute resolution within the conventional framework, with special reference to amicable procedure as the traditional procedure for settling interpretative disputes which are the crux of agreements to avoid double taxation. Given the failings of the amicable approach in this area, the author offers alternative mechanisms - based on contributions from comparative doctrines and from different international courts - concluding with the suitability of the arbitration system, whether for consultative proposals or for appeal before existing international courts. The new and original construction of international tax arbitration proposed herein gives, without doubt, an added value to this study.
