El presente artículo tiene como objetivo discurrir sobre los deberes que recaen sobre el juez, o sea, las garantías de jurisdicción, así como construir la imagen del mismo a partir de esas garantías. El deber de aplicar el Derecho coincide con lo que acostumbra llamarse “la garantía objetiva de la jurisdicción” y los deberes de independencia e imparcialidad con “las garantías subjetivas de la jurisdicción”. El análisis demostrará que, en términos prácticos, el incumplimiento de las garantías subjetivas tiene un potencial deslegitimador superior al incumplimiento de la garantía objetiva. Y también que, en términos conceptuales, las nociones de independencia y de imparcialidad son dependientes de la concepción del Derecho que se tenga.
The objective of this article is to discuss the duties of the judge i.e. the guarantees of the jurisdiction, and to construct its image based on those guarantees. The duty to apply the Law coincides with what is generally called the “objective guarantee of jurisdiction” and the duties of independence and impartiality with the “subjective guarantees of jurisdiction”. The analysis demonstrates that in practical terms, the non-fulfilment of the subjective guarantees is a potential higher delegitimizer of non-fulfilment of the objective guarantee. Furthermore, in conceptual terms, the notions of independence and impartiality are dependent on the commonly-held concept of Law.
