El presente artículo aborda el estudio del falso testimonio de perito e intérprete, analizando sus diversos elementos típicos y precisando el momento procesal en que puede ser cometido el delito, a partir de su consideración como delito de omisión, cuyo núcleo de injusto reside en faltar a la verdad y en el que el contenido del deber de veracidad se extiende no sólo a datos fácticos, objetivos, sino también a aspectos valorativos contrastables.
This paper analyzes the false testimony of expert and interpreter, studying the various typical elements of the offence and outlining the procedural stage in which the crime can be committed, based on its consideration as a failure to act [crime of omission], whose injustice lies in breach the duty of truthfulness in which the contents of this duty extends not only to factual, objective data but also to testable valuable aspects.
