Abstract

El texto analiza si es constitucionalmente válida la aplicación retroactiva de la legislación que permite el decomiso directo de las ganancias procedentes de actividades delictivas de los artículos 127, 127 ter y 127 quater del Código penal español. Para ello se examinan los argumentos doctrinales y jurisprudenciales tanto a favor como en contra de la retroactividad del decomiso de ganancias en el Derecho comparado y en el ordenamiento jurídico español. Pese a la falta de consenso doctrinal, se concluye que el decomiso de ganancias no tiene una naturaleza punitiva o sancionadora. Su fin es neutralizar el enriquecimiento patrimonial ilícito, por lo que su aplicación retroactiva no vulnera el principio de irretroactividad de las leyes penales desfavorables ni el principio de seguridad jurídica.

The text examines the constitutionality of the retroactive application of legislation that allows for the direct confiscation of proceeds from criminal activities under articles 127, 127 bis, and 127 ter of the Spanish Penal Code. To this end, it examines both supporting and opposing doctrinal and jurisprudential arguments regarding the retroactivity of the confiscation of proceeds in comparative law and within the Spanish legal system. Despite the lack of doctrinal consensus, it is concluded that profit confiscation does not have a punitive or sanctioning nature. Its aim is to neutralize illicit enrichment, and therefore, its retroactive application does not violate the principle of non-retroactivity of unfavorable criminal laws or the principle of legal certainty.
