El presente trabajo tiene por objeto el estudio de la consideración que tiene el derecho de autor en la normativa internacional, de la Unión Europea y nacional como derecho humano. Este capítulo aborda, también, su clasificación en la Constitución Española de 1978, su relación con otros derechos constitucionales y la ponderación de los diversos intereses en caso de conflicto. Todo ello en relación con el contexto digital que obliga a una adaptación constante de la normativa de derechos de autor. The aim of this paper is to analyze the consideration that copyright has in international, European Union and national regulation as a human right. This chapter also addresses its classification in the Spanish Constitution of 1978, its relationship with other constitutional rights and the balance between the different interests when those are in conflict. All the above-mentioned is studied taking into the account the digital context that demands frequent amendments in copyright law.
