Las bonificaciones medioambientales del IAE: principales parámetros empleados en su regulación por los municipios de más de 100.000 habitantes

Abstract

Ya han transcurrido más de dos décadas desde que el legislador concediera a los Ayuntamientos la posibilidad de introducir de forma potestativa bonificaciones medioambientales en sus impuestos locales. En nuestro estudio nos ocuparemos de las tres bonificaciones medioambientales que el TRLHL contempla para el IAE: por energías renovables, por actividades extrarradio y por transporte ecológico. Estudiaremos en qué medida dichas bonificaciones potestativas han sido empleadas por los municipios y cómo han regulado sus aspectos sustantivos y formales en sus respectivas ordenanzas fiscales del año 2021. En este sentido, trataremos de identificar los principales parámetros que los municipios de más de 100.000 habitantes han tenido en cuenta para regular dichas bonificaciones: límites temporales, importes máximos bonificados, requisitos mínimos exigidos, incompatibilidad con otras bonificaciones o la exigencia de requisitos adicionales para su disfrute, entre otros aspectos.

Este trabajo ha sido realizado en el marco del proyecto de investigación “La transformación del modelo energético: propuesta de un marco regulatorio integral para el desarrollo de las energías renovables (PRODENER)”, financiado por el Ministerio de Economía, Industria y Competitividad, en la convocatoria RETOS 2017 (Referencia: DER2017-89157-R).
