Abstract

El artículo analiza los términos en los que el Tribunal Constitucional delimita constitucionalmente el llamado “derecho de autodeterminación” para decidir de manera libre, informada y consciente el modo y momento de morir en situaciones médicamente contrastadas de enfermedades terminales o gravemente incapacitantes. El artículo concreta el objeto sometido a control jurisdiccional de constitucionalidad, significando el sustento constitucional de la “prestación de ayuda para morir” como derecho público subjetivo individual, de configuración legal y de carácter prestacional, directamente vinculado con el derecho a la integridad física y moral, el derecho a no sufrir tratos inhumanos ni degradantes y con el reconocimiento del derecho a la vida privada en el marco del artículo 8 del Convenio Europeo de los Derechos Humanos (CEDH). Desde este enfoque, el artículo referencia los límites y garantías constitucionales de la autodeterminación personal a la hora de poner fin a la propia vida en el llamado “contexto eutanásico” como presupuesto para la solicitud de la ayuda para morir. The article analyzes the terms in which the Constitutional Court constitutionally delimits the so-called "right of self-determination" to freely, informed and consciously decide the way and moment to die in medically proven situations of terminal or seriously disabling diseases. The article specifies the object subject to judicial control of constitutionality, meaning the constitutional support of the "help to die benefit" as an individual subjective public right, of legal configuration and of a benefit nature, directly linked to the right to physical and moral integrity. , the right not to suffer inhuman or degrading treatment and with the recognition of the right to private life within the framework of article 8 of the European Convention on Human Rights (ECHR). From this approach, the article refers to the limits and constitutional guarantees of personal self-determination when it comes to ending one's life in the so-called "euthanasia context" as a prerequisite for requesting aid in dying.
