This paper looks at how the European Cooperative Society Project rather than trying to standardise the different national regimes is, in fact, establishing a «new» Institution of a transnational nature through the Community. This implies a somewhat «indirect» standardisation based on the example that the European society may offer in order to encourage national legislation to adopt the European model.
