Los deberes internos a la práctica de la jurisdicción: aplicación del derecho, independencia e imparcialidad

Abstract

El artículo trata de construir la imagen del juez no desde el poder que ejerce (la jurisdicción), sino desde los deberes básicos que guían ese poder (las garantías de la jurisdicción): el deber de aplicar el Derecho (garantía objetiva) y los deberes de independencia y de imparcialidad (garantías subjetivas). A partir de ahí se muestran las asimetrías prácticas y las dependencias conceptuales entre unos y otros deberes.

The article tries to construct the image of the judge not from the power he exercises (jurisdiction), but from the basic guiding duties of this power (the warranties of jurisdiction): the duty to apply the law (objective warranty) and the duties to be independent and to be impartial (subjective warranties). Later, the article tries to show the practical asymmetries and the conceptual dependences among all these duties.

L’article tracta de construir la imatge del jutge no des del poder que exerceix (la jurisdicció), sinó des dels deures bàsics que guien aquest poder (les garanties de la jurisdicció): el deure d’aplicar el dret (garantia objectiva) i el deures d’independència i d’imparcialitat (garanties subjectives). A partir d’aquí es mostren les asimetries pràctiques i les dependències conceptuals entre uns i altres deures.
