La imparcialidad, desde las tres concepciones no escépticas del derecho y de su aplicación (formalismo legalista, positivismo normativista y post-positivismo), no es un lugar común, sino que es vista desde diferentes perspectivas que han tendido a confundirla con el concepto de neutralidad.
