El lucro cesante se presenta como una partida de daño patrimonial, cuya producción es, en muchas ocasiones, contingente, aspecto este que ha motivado que, desde antaño, la Sala Primera del Tribunal Supremo se mostrara reticente a la hora de su estimación. Tal aleatoriedad incide directamente sobre su eventual aseguramiento y, cómo no, sobre el régimen jurídico al que se ve sometido el seguro de lucro cesante ex arts. 63 y siguientes de la Ley de Contrato de Seguro, el cual tenemos aquí ocasión de analizar. Asimismo, nos pronunciaremos sobre el carácter delimitador, limitativo o lesivo que pudiera tener una cláusula inserta en la póliza de seguro, en cuya virtud se excluyera de cobertura el ingreso no percibido derivado de la paralización de la empresa, a resultas de la declaración del Estado de Alarma por parte del Gobierno central, con causa en la COVID-19. Loss of profits is one of the two classic items of property damage, the production of which is, on many occasions, contingent. In the past, this fact led the First Chamber of the Spanish Supreme Court to be restrictive when awarding it. Thus, as we shall see, that randomness has a direct effect on the insurance of loss of profit and on its legal regime, located in Articles 63 et seq. of the Spanish Insurance Contract Law. In this paper, we will also examine whether a clause inserted in the insurance policy, which excludes from coverage lucrum cessans derived from a business interruption, as a result of the declaration of the State of Alarm by the Spanish Central Government, due to COVID-19, has, in our opinion, a delimiting, restricting or injurious nature for the insured.
