Abstract

El presente trabajo se centra en la residencia fiscal de las personas físicas, haciendo especial referencia a algunos aspectos de actualidad como el trabajo a distancia o el control de los cambios de residencia mediante herramientas basadas en el procesamiento de Big Data. En primer lugar, se analizan las circunstancias por que una persona física tiene la condición de residente fiscal en España a propósito de jurisprudencia y doctrina administrativa reciente. Para después poner en relación las 'nuevas' formas de trabajo con la residencia de las personas físicas, incluyendo una referencia a los regímenes que permiten atraer talento internacional. Estas nuevas formas de trabajo, como el teletrabajo, pueden conllevar cambios de residencia. Para este, u otros casos, la Administración tributaria contempla emplear sistemas de inteligencia artificial para verificar que se trata de cambios de residencia válidos. The present article tackles the tax residence of individual persons with a special reference to new tendencies such as remote work or monitoring the changes of residence through strategies based on the processing of Big Data. First, the author analyses the circumstances under which a person is regarded as a tax resident in Spain in the light of recent case law and administrative doctrine. Then, the paper focuses on the 'new' ways of working and the regimes to attract international talent. These new forms of working, such as tele-working, may lead to changes of residence. For this, or other cases, the Tax Administration may use artificial intelligence systems to verify whether those changes of residence are valid. Este trabajo se enmarca en el proyecto de investigación "Data science y machine learning en el ámbito tributario" (PID2019-108963RB-I00) del Ministerio de Ciencia, Innovación y Universidades, y cuyos investigadores principales son los profesores Begoña Pérez y Jorge Martín.
