Abstract

La sentencia objeto de comentario en estas líneas es la STSJ Canarias, Las Palmas, de 22 de diciembre de 2010. La cuestión de fondo que se plantea en dicha sentencia es si el despido de una trabajadora que viene motivado por sus reiterados procesos de IT que han dado lugar a distintas bajas laborales, debe ser calificado como «improcedente» o «nulo». Como veremos, el TSJ llega a esta última solución por considerar que, en realidad, en este supuesto, la única causa que ha dado lugar al despido es la enfermedad de la trabajadora, lo cual supone castigar la enfermedad del trabajador que aparece como una carga para la empresa, convirtiendo así la enfermedad en una causa de discriminación.
