Abstract

Konsekvensutredninger (KU) er et vanlig instrument i planlegging av større tiltak på land. Når det gjelder tiltak i sjøområdene er det mindre utbredt, selv om det siden 1997 har vært mulig for forvaltningen å kreve KU for «større akvakulturanlegg». Definisjonen av større oppdrettsanlegg er knyttet til en lokalitetsstørrelse på 3600 MTB, eller mer. Utviklingen innen akvakulturnæringen har medført at stadig mer fisk produseres på færre lokaliteter. Mens man i 2006 hadde 20 lokaliteter som tangerte innslagspunkt på 3600 MTB, er det i dag 185 lokaliteter som er lik eller større enn 3600 MTB. I samme periode er det kun gjennomført fire konsekvensutredninger i forbindelse med søknad om matfisklokalitet. Vi har i denne rapporten sett på de formelle sidene ved KU-regimet og hvordan dette er hjemlet i lovverk og forskrifter. Med det som utgangspunkt beskriver vi også på hvilken måte KU-instrumentet aktualiseres forhold til akvakulturvirksomhet, både på tiltaks- og plannivå. Videre har vi sett på hvordan KU-regimet praktiseres i akvakultursektoren ved gjennomgang av utvalgte case innen lakse- og torskeoppdrett, og vist innhold i utredningsprogram, metodebruk og viktige konklusjoner i rapportene. Eksempler fra annen næringsvirksomhet som påvirker det marine miljøet er også drøftet. Vi kan konkludere med at tiltak som pålegges konsekvensutredning får en forholdsvis lang søknadsprosess (3-4 år). Ingen av tiltakene med KU har hittil endt med en positiv klarering. Det er usikkert om dagens praktisering av KU gir en bedre beslutningsstøtte for forvaltningen og nødvendig forutsigbarhet for tiltakshaver. Verktøyet er umodent med behov for nye praktiske veiledere både på tiltaks- og plannivå.

Prior to establishing a large fish farm (3600 mtb), there must be decided whether it is necessary to perform an environmental impact assessment (EIA). We have in this report looked at both the formal, administrative and practical aspects of the EIA regime, both for aquaculture facilities and with regards to the coastal zone planning. We conclude that the EIA regime seems unpredictable and involves a comprehensive process. No EIA has so far resulted in a positive clearance of aquaculture facilities. There seems to be uncertain whether the current practice of EIA provides a better basis for the authority’s decision making and the necessary predictability for the industry.
