Barns deltakelse i mekling. Påvirker det samarbeidet mellom foreldrene?

Abstract

Formålet med oppgaven var å undersøke om barns deltagelse i mekling påvirker samarbeidet mellom foreldrene, sett ut ifra foreldrenes opplevelse. Vi ønsket også å undersøke om samarbeidet mellom foreldrene påvirkes ulikt ut ifra om det mekles etter ekteskapsloven, barneloven (samboende i brudd eller tvist om foreldreansvar). Videre ble foreldre og meklers vurdering av konfliktnivået sammenlignet. Undersøkelsen er basert på kvantitativ data fra forskningsprosjektet ”Høring av barn i mekling” som gjennomføres ved RKBU-Nord. Det ble ikke funnet noen signifikant assosiasjon mellom barns deltakelse og samarbeid mellom foreldrene. Som forventet var konfliktnivået ved mekling etter barneloven (tvist om foreldreansvar) signifikant høyere enn ved de andre to meklingstypene. Videre fant vi at mekler vurderte konfliktnivået som signifikant lavere enn foreldrene selv ved evalueringssamtalen etter seks måneder. Til tross for at det ikke ble funnet en signifikant forskjell ved barns deltagelse og foreldresamarbeidet, rapporterer en stor andel at det hadde en positiv betydning for samarbeidet. Det er et behov for økt kunnskap om forhold som kan bidra til et bedre samarbeid og redusert konfliktnivå mellom foreldre. Barns rettigheter har de senere årene fått økt oppmerksomhet, og det er grunn til å anta at det etter hvert vil implementeres en norm om barns deltakelse, uavhengig av om dette påvirker foreldresamarbeidet.
