El hecho de que la persona trabajadora sea mujer, transexual o de tercer género/sexo, así como su orientación sexual, puede incidir sobre el régimen del contrato de trabajo transfronterizo. En cada colectivo existen dificultades específicas para garantizar un tratamiento y unas condiciones laborales igualitarias y respetuosas con la identidad de género y la orientación sexual ya desde la fase de selección. Además, con carácter general, resulta problemática la aplicación de las disposiciones resultantes de la negociación colectiva que tienen el objetivo de garantizar la igualdad.
The fact that the worker is a woman, transgender or third gender/sex, as well as the sexual orientation, can have an impact on the regime of the cross-border employment contract. In each category, there are specific problems in ensuring equal treatment and working conditions that are respectful regarding gender identity and sexual orientation from the recruitment phase.
