Abstract

This thesis examines the limits of International Human Rights Law and International Humanitarian Law in recognizing and protecting women’s bodies during non-international armed conflicts in Latin America. Using a critical legal approach and a comparative analysis of three case studies (Colombia, Guatemala, and El Salvador), it identifies the existence of a normative “grey zone” that hinders the classification, investigation, and prosecution of sexual violence as a war crime. The findings confirm the hypothesis that current international law, in both its normative and practical configuration, does not guarantee effective protection for women in non-international armed conflicts contexts, thereby contributing to structural impunity and the denial of real access to justice and reparations. The study proposes legal reforms, stronger complementarity between IHRL and IHL, accountability mechanisms for non-state armed actors, and victim-centered policies to overcome these gaps.

Este trabajo examina los límites del DIDH y del DIH para reconocer y proteger la corporalidad de las mujeres en CANI en América Latina. A partir de un enfoque jurídico-crítico y del análisis comparado de tres casos (Colombia, Guatemala y El Salvador), se identifica la existencia de una vacíos en la normativa que dificulta la tipificación, investigación y sanción de la violencia sexual como crimen de guerra. Los hallazgos confirman la hipótesis de que el derecho internacional vigente, en su configuración normativa y práctica, no garantiza una protección efectiva de las mujeres en contextos de CANI, lo que contribuye a la impunidad estructural y a la negación del acceso real a la justicia y la reparación. El estudio propone reformas legales, mayor complementariedad entre DIDH y DIH, mecanismos de rendición de cuentas para actores no estatales y políticas centradas en las víctimas para superar dichas lagunas.
