El impacto de la inteligencia artificial en la evolución del derecho de autor hacia el derecho de imagen

Abstract

El presente trabajo estudia el impacto de la Inteligencia Artificial en el sector artístico, donde cada vez es más frecuente la generación de obras o interpretaciones en las que se imita la imagen o voz de los artistas sin su debido consentimiento. Por tanto, esta realidad pone de manifiesto la necesidad de buscar alternativas a la concepción actual del Derecho de Autor, proponiendo un Derecho de Imagen remunerado. En especial, en el actual momento resulta preciso crear una legislación específica que proteja los derechos de los artistas, reconociéndoles una remuneración adecuada por los resultados generados por la Inteligencia Artificial.

This paper explores the impact of Artificial Intelligence in the artistic sector, where it is increasingly common the generation of works or interpretations in which the image or voice of artists are imitated without their due consent. Therefore, this fact highlights the need to seek alternatives to the current conception of Author Rights, proposing a remunerated Image Right. In particular, at the present time it is necessary to create a specific legislation that protects artists’ rights, recognizing them an adequate remuneration for the results generated by Artificial Intelligence.
