El acelerado desarrollado de las tecnologías, junto con la generalización del acceso a internet y el uso de dispositivos móviles a edades cada vez más tempranas, ha incrementado la exposición de los menores a los riesgos presentes del entorno digital, lo que los convierte en sujetos especialmente vulnerables frente a la acción de los ciberdelincuentes. Ante este escenario, el legislador ha impulsado una serie de medidas a través del Anteproyecto de la Ley Orgánica de protección de personas menores de edad en medidas y reformas orientadas a reforzar la seguridad jurídica de este colectivo. Dichas modificaciones normativas pretenden establecer un marco de protección eficaz que garantice un desarrollo seguro para la infancia y la adolescencia en el ámbito del ciberespacio. El objetivo de este trabajo es entender los peligros a los que se enfrentan los menores en internet, como les afectan, las medidas que existen para protegerlos, así como la aparición de nuevas herramientas delictivas, entre las que destaca el uso malicioso de la Inteligencia Artificial, junto con un análisis prospectivo de previsiones contenidas en el Anteproyecto de la Ley Orgánica de protección de personas menores de edad.

The accelerated development of technologies, along with the widespread access to internet and the use of smartphones at increasingly younger ages, has increased the exposure of minors to risk derived from the digital environment, making them particularly vulnerable to cybercriminals. In response to this scenario, the legislator has promoted a series of measures through the Draft Organic Law for the protection of the minors in the digital environment. These modifications aim to establish an effective protection framework that guarantees a safe development for children and young people in the cyberspace. The purpose of this study is to understand the dangers face by the minors on the internet, how they affect them, the mechanisms that exit to protect them, as well as the emergence of new criminal tools, among which the malicious use of AI stands out, besides with a prospective analysis of projections in the Draft Organic Law for the minor’s protection.
