Abstract

Con la redacción de este trabajo tratamos de exponer el estudio de las anomalías psíquicas como eximentes de responsabilidad penal. Para ello partiremos del estudio de la imputabilidad, la culpabilidad y los requisitos de las mismas. Partiremos de un primer análisis sobre el concepto y el desarrollo histórico de la culpabilidad, conociendo las distintas teorías expuestas por los juristas a lo largo de la historia, donde impera el término “reprochabilidad”. De igual manera procederemos a exponer el concepto de anomalías psíquicas, que, como ya sabemos, han existido siempre, pero su entendimiento y tratamiento no siempre ha sido el mismo. Mi intención con este trabajo es entender lo que supone padecer una anomalía psíquica, permanente o transitoria, con sus correspondientes distinciones, y la influencia que esta tiene en la responsabilidad penal que se le pretende atribuir a los sujetos autores de un hecho delictivo; pues es determinante para la inimputabilidad o para la aplicación de una simple atenuante, dependiendo del tipo de anomalía psíquica que se padezca y, sobre todo, de la intensidad de la anomalía, de si es tan grave que anula la culpabilidad. Además, expondremos la evolución que se desarrolla a lo largo de la historia sobre las anomalías psíquicas, tanto en el concepto propio, como en el desarrollo de la misma en el ámbito penal. No debiendo olvidar las demás causas posibles de inimputabilidad que no corresponden a las anomalías psíquicas, como son; la minoría de edad, sufrir alteraciones en la percepción y la intoxicación por consumo de bebidas alcohólicas o drogas.

With the writing of this work we try to expose the study of psychic anomalies as defenses of criminal responsibility. To do this we will start from the understanding of imputability, guilt and their requirements. We will start with a first analysis of the concept and historical development of guilt, knowing the different theories expounded by jurists throughout history, where the term “reproachability” prevails. As well as later, the exposure of psychic anomalies, which, as we already know, have always existed, but their understanding and treatment has not always been the same. My intention with this work is to understand what it means to suffer from a mental anomaly, permanent or temporary, with its corresponding distinctions, and the influence that this has on the criminal responsibility that is intended to be attributed to the subjects who are the perpetrators of a criminal act; since it is decisive for non-imputability or, on the other hand, for the attribution of a simple mitigating circumstance, depending on the type of psychic anomaly suffered. In addition to the evolution that develops throughout history regarding psychic anomalies, both in its own concept and in its development in the criminal field. Not having to forget the other possible causes of non-imputability that do not correspond to psychic anomalies, such as; minority, suffering alterations in perception and intoxication due to consumption of alcoholic beverages or drugs.
