El imparable avance de las TICs junto con el acceso temprano de los menores de edad a las redes sociales y en general, a internet, ha motivado la aparición de nuevas figuras delictivas, así como la evolución de las ya existentes. Todo ello, junto con la falta de un filtro efectivo en las aplicaciones y de un control parental activo han determinado la consolidación de numerosos peligros y amenazas a la hora de usar estos servicios en línea, surgiendo así la necesidad de que el legislador ofrezca una respuesta concreta a estos nuevos desafíos. En consecuencia, en el presente estudio abordaremos los principales “ciberdelitos” cometidos a través de internet sobre los más vulnerables, esto es, los menores de edad. En su desarrollo, expondremos la cuestión y veremos el marco normativo aplicable. Una vez sentado lo anterior analizaremos, mediante un estudio doctrinal y jurisprudencial actualizado, los delitos de sexting, sextorsión, child grooming, embaucamiento a menores con fines sexuales a través de las TICs y, el ahora unificado, delito de agresión sexual a menores de dieciséis años. De esta manera lograremos exponer cómo un uso incorrecto de las redes sociales puede terminar ocasionando graves daños en la vida de los menores y pondremos de manifiesto la necesidad de concienciar activamente sobre los riesgos que conlleva utilizar plataformas en línea, a una temprana edad, sin establecer medidas que garanticen su seguridad y un libre desarrollo sin interferencias.
The unstoppable advancement of ICTs, along with the early access of minors to social networks and the internet in general, has led to the emergence of new criminal figures, as well as the evolution of existing ones. All of this, coupled with the lack of effective filtering in applications and active parental control, has determined the consolidation of numerous dangers and threats when using these online services, thus arising the need for the legislator to offer a concrete response to these new challenges. Consequently, in the present study, we will address the main “cybercrimes” committed through the internet targeting the most vulnerable, namely, minors. In its development, we will expose the issue and examine the applicable legal framework. Once this is established, we will analyze, through an updated doctrinal and jurisprudential study, crimes such as sexting, sextortion, child grooming, deception of minors for sexual purposes through ICTs, and the now unified crime of sexual assault on minors under sixteen years old. In this way, we will demonstrate how an incorrect use of social networks can result in serious harm to the lives of minors and highlight the need to actively raise awareness about the risks of usind online platforms at an early age, without establishing measures to ensure their safety and free development without interference.
