En un Estado social y democrático de Derecho, las prestaciones sociales son un instrumento necesario para garantizar una vida digna a ciertos grupos de personas, lo que les garantizará un cierto nivel de libertad. El objeto de este trabajo es estudiar las exigencias establecidas por el Tribunal Europeo de Derechos Humanos para que las prestaciones sociales estén protegidas por el artículo 1 Protocolo Adicional 1 del Convenio Europeo de Derechos Humanos. En concreto, analizaré el alcance de la protección que les otorga el citado precepto según la interpretación del Tribunal Europeo de Derechos Humanos, haciendo especial énfasis en la protección de los sistemas de Seguridad Social de los países miembros, en particular de las pensiones. Estudiaré los límites que dicha jurisprudencia impone a la modificación de los mismos.
In a social and democratic rule of law, social benefits are a necessary tool to ensure a dignified life for certain groups of people, which will guarantee them a certain level of freedom. The purpose of this study is to examine the requirements established by the European Court of Human Rights for social benefits to be protected under Article 1 of Additional Protocol 1 of the European Convention on Human Rights. Specifically, I will analyse the extent of the protection provided by the said provision according to the interpretation of the European Court of Human Rights, with a particular emphasis on the protection of the Social Security systems of member countries, especially pensions. Investigaré las restricciones que esta jurisprudencia establece para modificar los límites.
