Investigación de la irreproducibilidad de la prueba pericial según el marco legislativo mexicano actual considerando aspectos legales y científicos

Abstract

La reforma constitucional respecto al derecho penal que se gestó en México introdujo nuevos cambios respecto a la prueba y en específico sobre la prueba pericial. La pericia en México experimentó dificultades orientadas principalmente en el campo científico-técnico. Por ello, este estudio se ha orientado a investigar el paradigma de la reproducibilidad de la prueba científico forense regulada en el artículo 274 del Código Nacional de Procedimientos Penales, aplicable en todo México, relativo al concepto de “prueba pericial irreproducible”. Se ha investigado la concepción de “prueba pericial irreproducible” en el contexto de diferentes ciencias forenses: química, toxicología, genética y medicina, cada uno en un enfoque especifico de prueba. Se comenzó el estudio teniendo como punto de partida que la conservación de las muestras en las diferentes ciencias forenses estudiadas permitiera su repetición presente y futura. El conocimiento evaluado a expertos oficiales de toda la República Mexicana, arrojo la falta de conocimiento en varias técnicas de conservación, así como ausencia de infraestructura que permitiesen la reproducibilidad de sus pericias. El conocimiento de la terminología de irreproducibilidad, de su nacimiento en el esquema penal mexicano y la participación de expertos de laboratorios oficiales en México en este estudio, permitió la creación de una propuesta proactiva y legislativa pericial, que puede ser una solución a este problema en la práctica forense mexicana.
