Abstract

El presente trabajo tiene como objetivo analizar la figura de la prescripción adquisitiva, su regulación y la finalidad de su existencia, así como realizar un estudio de sus características y numerosos matices, jugando siempre con la comparación entre la doctrina, encontrándonos autores que han aportado en gran medida al desarrollo e interpretación de esta figura, así como la jurisprudencia, con la ejemplificación de sentencias en un amplio rango de tiempo, que permiten apreciar tanto la consolidación de una línea jurisprudencial clara en determinados aspectos de la figura, como la falta de la misma, y las discrepancias que pueden surgir entre los Tribunales. La intención es aunar los aspectos relevantes y analizar tanto la parte teórica y práctica, y dar una visión general de su funcionamiento, y de los problemas que se pueden presentar en su aplicación. Para ello, se expondrá en primer lugar el objetivo que tiene esta figura de cara a la sociedad y al plano jurídico, se hablará sobre los tipos de usucapión que existen, continuando con las características comunes a ambos tipos, así como aquellas que los diferencian. Finalmente, vemos como se relaciona la figura con el Registro de la Propiedad.

The purpose of this essay is to analyze the figure of the acquisitive prescription, its regulation and the aim of its existence, as well as to carry out a study of its characteristics and numerous nuances, always playing with the comparison among the doctrine, meeting authors who have contributed significatly to the development and the interpretation of this figure, and jurisprudence, with the exemplification of the sentences in a wide range of time, that allow us to appreciate both the consolidation of clear jurisprudential line and the lack thereof, and the discrepancies that may arise in the courts. The intention is to bring together the relevant aspects and to analyze both the theorical and practical part, and give an overview of its operation, and the problems encountered in its application. For this purpose, the goal of the figure with respect to society will be explained, as well as the legal aspects, and then, the types of usucapion that exist will be discussed, continuing with the characteristics common to both types, as well as those that differentiate them. Finally, we see how the figure relates to the Land Registry.
