La prejudicialidad penal en los procedimientos arbitrales.

Abstract

A lo largo del transcurso del tiempo, siempre ha existido y sigue existiendo una disputa sobre si el arbitraje tiene un mayor nivel de ventajas o de desventajas en comparación con lo que a la jurisdicción ordinaria se refiere. Siempre se recurre a alegar la acentuada celeridad de los procesos arbitrales como una gran ventaja a su favor, pudiendo conseguir una resolución del conflicto en un transcurso del tiempo bastante más reducido del que surgiría por la jurisdicción ordinaria. Sin embargo, no todo puede verse envuelto en una nube de perfección e idoneidad, y a veces surgen contratiempos que hacen que dicha celeridad se vea envuelta en un imposible, como pueden ser la formalización del mismo arbitraje, la efectiva y necesaria práctica de la prueba, el surgimiento de adopción de medidas cautelares, etc. Añadido a lo anterior, se entiende un gran punto de inflexión en la celeridad del arbitraje e, incluso en su posibilidad de continuación, que alguna de las partes envueltas en el proceso alegue una cuestión prejudicial penal. En este trabajo, se pretende analizar el seguimiento y la perspicacia de la prejudicialidad penal en lo que al proceso arbitral se refiere, así como la exposición de casos de elevada relevancia en la actualidad y su afección en el futuro.

Throughout time, there has always been and there is a controversy as to whether arbitration has a higher level of advantages or disadvantages compared to ordinary jurisdiction. However, not everything can be wrapped in a cloud of perfection and suitability, and sometimes setbacks arise that make such celerity impossible, such as the formalization of the arbitration itself, the effective and necessary practice of the evidence, the adoption of precautionary measures, etc. In addition to the above, it is understood to be a major turning point in the speed of arbitration, and even in the possibility of its continuation, that one of the parties involved in the process may allege a criminal prejudicial matter. This paper aims to analyze the monitoring and knowledge of criminal prejudiciality in what refers to the arbitration process, as well as the presentation of highly relevant cases and their effect in the future.
