En el presente estudio se analizan los derechos referentes al domicilio que ostentan los ciudadanos, relacionándolos con el cumplimiento de los deberes en materia de investigación por parte de la Administración que supongan una injerencia domiciliaria. Primeramente, se contextualiza el ámbito del derecho en el que se desenvuelve el trabajo de investigación, realizando un breve resumen sobre los conceptos básicos que nos interesan en este caso sobre el Derecho Administrativo. En segundo lugar, se trata el concepto de domicilio, el alcance de la protección del mismo, y, por ende, los derechos de los que son titulares las personas, tanto físicas como jurídicas, en ese sentido. En los siguientes apartados, analizaremos las características del procedimiento administrativo objeto del presente estudio, es decir, la ejecutividad de las injerencias domiciliarias, las formas legítimas de proceder, la competencia y demás aspectos procedentes, en dos ámbitos concretos: el derecho administrativo y la inspección tributaria. Por último, se dedicará un apartado a saber cómo opera el caso de los despachos profesionales en el objeto del trabajo, es decir, el registro de los despachos profesionales y sus peculiaridades. En definitiva, este trabajo trata de estudiar todas las controversias que se suscitan entre el derecho administrativo y el derecho a la inviolabilidad del domicilio, analizando los principales pronunciamientos jurisprudenciales y la legislación.

In the present study, the rights of reference to the home held by citizens are analyzed, relating them to the fulfillment of the duties in the matter of investigation by the Administration that suppose a home interference. Firstly, the field of law in which the research work takes place is contextualized, making a brief summary of the basic concepts that interest us in this case on Administrative Law. Secondly, it deals with the concept of domicile, the scope of its protection, and, therefore, the rights of those who are owners of persons, both physical and legal, in this sense. In the following sections, we will analyze the characteristics of the administrative procedure of this study, that is, the enforceability of domiciliary interference, legitimate ways of proceeding, competition and other derived aspects, in two specific contours: administrative law and tax precision. . Finally, a section will be dedicated to knowing how the case of professional offices operates in the object of the work, that is, the registry of professional offices and their peculiarities. In short, this work tries to study all the controversies that arise between administrative law and the right to the inviolability of the home, analyzing the main jurisprudential pronouncements and legislation.
