La justicia restaurativa

Abstract

La Justicia Restaurativa, o mediación penal, es un método alternativo de resolución de controversias que, mientras que en el Sistema Jurídico Español hasta ahora ha tenido poca o ninguna importancia, en otros Estados es habitualmente aplicada en los conflictos penales. Esto es así porque la Justicia española, se basa en un sistema de Justicia retributivo, y no restaurativo. Con el método restaurativo, las partes, asistidas por un tercero ajeno, participarán activamente para llegar a un acuerdo, que a veces no se consigue en un proceso judicial con sentencia. Además, esta herramienta permitirá “liberar” al poder judicial de tantos litigios y demostrar los beneficios jurídicos que hay tanto para la víctima como para el infractor. En este trabajo se pretende dar a conocer esta reciente modalidad desarrollando los aspectos más importantes, exponiendo varios casos reales y acentuando la relevancia que pueda llegar a tener en el futuro.

Restorative justice, or criminal mediation, is an Alternative Dispute Resolution Method that, while in the Spanish Legal System until now has had little or no importance, in other States it is usually applied in criminal conflicts. This is so because the Spanish Justice is based on a retributive justice system, and not a restorative one. With the restorative method, the parts, assisted by an outside third part, will actively participate to reach an agreement, which is sometimes not achieved in a judicial process with a sentence. In addition, this tool will allow the judiciary to be "freed" from so many litigations and demonstrate the legal benefits that exist for both the victim and the offender. In this work it intends to make this recent modality known, developing the most important aspects, exposing several real cases, and emphasizing the relevance that it may have in the future.
