Desde hace años, una de las cuestiones que más polémica social genera está relacionada con la actuación de las fuerzas policiales, especialmente en aquellos casos en que se recurre al uso de la fuerza. El presente trabajo tiene por objeto mostrar el tratamiento jurídico-penal que se ofrece a este tipo de intervenciones de los agentes policiales. Para ello, es preciso comenzar realizando un estudio de la normativa, tanto nacional como internacional, que habilita la actuación policial. Partiendo de esta obligación legal de intervenir, expondremos el régimen jurídico que otorga nuestro Código Penal a las conductas típicamente antijurídicas realizadas por los agentes en el ejercicio de sus funciones, para cuya concreción, y ante la falta de previsión legal especifica, será imprescindible recurrir a los estudios doctrinales y jurisprudenciales en la materia, que concretan los requisitos precisos para legitimar las actuaciones de policías y eximir de responsabilidad penal a los mismos, jugando un papel fundamental la necesidad del recurso a la coacción.

For years, one of the issues that generates the most social controversy has been related to the actions of the security forces, especially in those cases in which the use of force is resorted to. The objective of this present work is to show the legal-criminal treatment that is offered to this type of interventions of police officers. To do this, it is necessary to begin with a study of the national and international regulations that police action. Based on this legal obligation to intervene, we will set out the legal regime that our Criminal Code grants to typically unlawful conduct carried out by agents in the exercise of their duties, for the specification of which, in the absence of a specific legal provision, it will be essential to resort to doctrinal and jurisprudential studies on the subject, which specify the precise requirements to legitimize police actions and exempt them from criminal liability, with the need to resort to coercion playing a fundamental role.
