Agotamiento del derecho de marca en el entorno digital

Abstract

Si bien es cierto que el origen de la marca como tal viene desde la antigüedad, la evolución de la misma ha sido mucho más reciente. Tal y como veremos, el mayor desarrollo comienza en el siglo pasado. En este trabajo desarrollaremos un estudio que irá desde un aspecto más general de la marca a, paulatinamente, desarrollar el tema principal de este estudio, el agotamiento del derecho de marca. Se irán analizando diversas sentencias dictadas por el Tribunal de Justicia de la Unión Europea donde se estudiarán las diversas características a tener en cuenta para definir y limitar el agotamiento del derecho de marca.

Although it is true that the origin of the brand as such comes from ancient times, its evolution has been much more recent, as we will see the greatest development begins in the last century. In this work we will develop a study that will go from a more general aspect of the trademark, to gradually develop the main theme of this study, the exhaustion of trademark rights. Various judgments issued by the Court of Justice of the European Union will be analyzed, where the various characteristics to be taken into account to define and limit Trademark right exhaustion will be studied.
