La inimputabilidad penal

Abstract

Con la realización de este trabajo, se pretenden repasar el concepto de culpabilidad y sus elementos. Tras ello, se expondrán las causas de inimputabilidad, también llamadas causas de exclusión de la capacidad de culpabilidad. Éstas son: la minoría de edad penal, las anomalías o alteraciones psíquicas y la alteración en la percepción. Por último, se analizará la actio libera in causa, el error de prohibición, el estado de necesidad disculpante y el miedo insuperable.

The aim of this work is to present a review of the concept of ‘culpability’ and its elements. After that, there will be exposed the causes of unimputability, also known as causes of exclusion of capacity of blame. These are the minimum age of criminal responsibility, the mental disorders and the perceptual alteration. Finally, the principles ‘actio libera in causa’, ‘prohibition error’, ‘necessity as an excuse’, and ‘insurmountable fear’ will be studied.
