Abstract

En este trabajo abordaremos, desde un punto de vista jurídico, el Título XV bis del Código Penal denominado “Delito contra los derechos de los ciudadanos extranjeros” que regula el tráfico ilícito de migrantes. Empezaremos analizando el concepto, tanto a nivel internacional como nacional. Una vez definido el delito, procederemos a la determinación del bien jurídico protegido elaborando un análisis del tipo básico, subtipos agravados y atenuado. Después explicaremos la ausencia de responsabilidad del migrante que ha sido objeto del tráfico ilegal, la responsabilidad de las personas jurídicas y el supuesto de ayuda humanitaria como causa de exención de la responsabilidad. Tal y como se pone de manifiesto en el título del trabajo, abordaremos la cuestión relativa a la delimitación existente entre los delitos de tráfico ilegal de migrantes y trata de seres humanos, analizando las diversas reformas que ha sufrido el Código Penal para comprender la evolución de ambos delitos. Por último, desarrollaremos cuestiones concursales.

In this work we will address, from a legal point of view, Title XV bis of the Penal Code called “Crime against the rights of foreign citizens” that regulates the smuggling of migrants. We will start by analyzing the concept, both internationally and nationally. Once the crime is defined, we will proceed to the determination of the protected legal asset, elaborating an analysis of the basic type, aggravated and attenuated subtypes. Then we will explain the absence of responsibility of the migrant who has been the object of illegal trafficking, the responsibility of legal persons and the assumption of humanitarian aid as a cause of exemption from responsibility. As shown in the title of the work, we will address the issue of the existing delimitation between the crimes of illegal smuggling of migrants and trafficking in human beings, analyzing the various reforms that the Penal Code has undergone to understand the evolution of both crimes. Finally, we will develop bankruptcy issues.
