This paper will focus on the study, both doctrinal and jurisprudential, of the crime of fraud. Due to the extension of the work, the investigation will only deal with the basic type of the crime established in the article 248.1 Criminal Code, without getting into the types equated to the fraud of the article 248.2 nor in the aggravated frauds of the article 250 Criminal Code. To this end, we will first explain the concept of fraud, as well as the legal asset protected from crime (personal assets), explaining each of the different concepts that the doctrine gives about it. We will continue with an analysis of the different elements of the type, both the objective ones - deception, error, act of disposition of patrimony and economic damage - and the subjective ones - deceit and profit-. Then, we will mention the iter criminis, the authorship and participation and the different problems in connection with other crimes. Finally, we will address some special cases of the crime of fraud such as the pyramid scheme or the figure of the scammed scammer.

El presente trabajo se va a centrar en el estudio, tanto doctrinal como jurisprudencial, del delito de estafa. Debido a la extensión del trabajo, la investigación solo se ocupará del tipo básico del delito establecido en el art. 248.1 CP sin llegar a entrar en los tipos equiparados a la estafa del artículo 248.2 ni en las estafas agravadas del artículo 250 del CP. Para ello, vamos a exponer, en primer lugar, el concepto de la estafa, así como el bien jurídico protegido del delito (el patrimonio), explicando cada uno de los distintos conceptos que la doctrina da sobre él. Continuaremos con un análisis de los diferentes elementos del tipo, tanto los objetivos - engaño, error, acto de disposición patrimonial y perjuicio económico‒ como los subjetivos ‒dolo y ánimo de lucro‒. Mencionaremos a continuación, el iter criminis, la autoría y participación y los diferentes problemas concursales con otros delitos. Por último, abordaremos algunos supuestos especiales del delito de estafa como la estafa piramidal o la figura del estafador estafado.
