La crisis financiera y económica que sufrió España a partir del año 2008 provocó que muchas empresas comenzaran a tener dificultades de liquidez, que obligaron a muchas de ellas a solicitar la declaración del concurso de acreedores. En este trabajo analizamos el deber de solicitar la la declaración de concurso que en nuestro sistema pesa sobre el deudor insolvente. Contextualizando el tema, empezamos por abordar las sucesivas reformas de la Ley Concursal y su relación con las modificaciones del artículo 5 y el artículo 5 bis de la Ley Concursal. Seguidamente, analizamos el presupuesto subjetivo y objetivo del concurso y su relación con el deber del deudor de solicitar el concurso, la solicitud de declaración de concurso por el deudor y el cumplimiento del deber, así como las consecuencias de su eventual incumplimiento. A continuación abordamos otros aspectos relativos al procedimiento concursal en relación con el deudor, para acabar, por último, estableciendo unas conclusiones sobre el tema. En este trabajo también se recogen referencias al régimen especial respecto a la solicitud de declaración del concurso de acreedores establecido en relación al COVID-10 que ha suspendido el deber del deudor de solicitar el concurso hasta el 31 de diciembre de 2020.
The financial and economic crisis suffered by Spain from 2008 onwards caused many companies to start having liquidity difficulties, which forced many of them to file for bankruptcy. In this paper we analyse the duty to apply for a declaration of bankruptcy that in our system weighs on the insolvent debtor. Contextualizing the issue, we begin by addressing the successive reforms of the Bankruptcy Law and their relationship with the amendments to Article 5 and Article 5 bis of the Bankruptcy Law. We then analyse the subjective and objective budget of the bankruptcy and its relationship with the debtor's duty to apply for bankruptcy, the application for a declaration of bankruptcy by the debtor and compliance with the duty, as well as the consequences of any failure to comply. We then go on to discuss other aspects of the bankruptcy procedure in relation to the debtor, finally establishing some conclusions on the subject. This paper also includes references to the special regime regarding the application for a declaration of insolvency established in relation to the COVID- 10 which has suspended the debtor's duty to apply for insolvency until 31 December 2020.
