En la primera parte del Trabajo, se ha tenido en cuenta, a modo de introducción en el tema que nos ocupa, abordar aspectos relativos a la evolución histórica de los servicios públicos, mencionando las etapas que han transcurrido desde su inicio hasta alcanzar en la actualidad los parámetros que definen el concepto moderno de servicio público que abarca actividades administrativas de manera amplia o restringida, de forma libre o sometidos a condiciones y requisitos limitativos (tasa, precio público, tarifa, etc…). A continuación se ha analizado los principales tipos de servicios públicos con sus respectivas características y sus principios rectores que cobran una importancia relevante, a la hora de asegurar prestaciones de alta calidad y conforme a la universalidad, igualdad y no discriminación. Posteriormente se ha tratado de examinar la contratación pública en España, como las concesiones en concreto, de acuerdo con las normas internas, sobre todo la nueva Ley 9/2017 de 8 de noviembre de contratos del sector público, por la que se trasponen a nuestro ordenamiento jurídico las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE de 26 de febrero de 2014 y que pretende delimitar la interposición anti-formalista del principio de riesgo y ventura concesional, que han adoptado varios Estados Miembros. Algunas relevancias derivadas de la Ley 9/2017, de 8 de noviembre de contratos del sector público podemos resaltar la novedad de la gestión indirecta de los servicios públicos, y que ha supuesto la supresión del contrato de gestión de servicio público. Se utilizan los tipos de concesión o de contrato de servicios, dependiendo de la transferencia del riesgo operacional al contratista.
It has been taken into account, as an introduction to the topic at hand, to address aspects related to the historical evolution of public services in the first part of this work. Stages that have elapsed from its beginning have been mentioned the until reaching today the parameters that define the modern concept of public service that covers administrative activities in a wide or restricted way, freely or subject to conditions and limiting requirements (rate, public price, rate, etc ...). Next, the main types of public services with their respective characteristics and their guiding principles that are relevant have been analyzed, when it comes to ensuring high quality services and in accordance with universality, equality and non-discrimination. Subsequently, public procurement in Spain has been tried to examine, such as concessions in particular, in accordance with internal regulations, especially the new Law 9/2017 of November 8 of public sector contracts, which transpose our legal order of the Directives of the European Parliament and of the Council 2014/23 / EU and 2014/24 / EU of February 26, 2014 and which aims to delimit the anti-formalistic interposition of the principle of risk and concessional venture, which several Member States have adopted. Some relevance derived from Law 9/2017, of November 8 of public sector contracts, we can highlight the novelty of the indirect management of public services, and that has led to the abolition of the public service management contract. The types of concession or service contract are used, depending on the transfer of operational risk to the contractor.
