El objetivo de este trabajo consiste en el análisis de la modalidad procesal especial del despido disciplinario en el orden jurisdiccional social. Este procedimiento ofrece la posibilidad de extinguir el contrato de trabajo a instancia del empresario, con especial atención a las causas que justifican dicha decisión empresarial. El trabajador deberá cumplir una serie de requisitos para impugnar el despido disciplinario en caso de que no esté de acuerdo con la decisión tomada por el empresario. Antes de acudir a la vía judicial, el trabajador deberá, en todo caso, proceder al agotamiento de la vía previa o a la conciliación administrativa. Una vez realizado este trámite, sin haber llegado a ninguna solución, el trabajador podrá interponer la demanda y una vez admitida, se celebrará el acto del juicio. Dicho acto acabará con una sentencia que calificará el despido como procedente, improcedente o nulo. La calificación también podrá ser recurrida por el trabajador y dependiendo de la nueva resolución que se dicte, tendrá unas consecuencias u otras.
The objective of this work consists in the analysis of the special procedural modality of disciplinary dismissal in the social jurisdictional order. This procedure offers the possibility of terminating the employment contract at the request of the employer, with special attention to the causes that justify said business decision. The worker must meet a series of requirements to challenge the disciplinary dismissal in case he does not agree with the decision made by the employer. Before going to court, the worker must, in any case, proceed to exhaustion of the previous way or administrative conciliation. Once this procedure is completed, without reaching any solution, the worker may file the claim and once admitted, the trial will be held. Said act will end with a sentence that will qualify the dismissal as appropriate, inadmissible or void. The qualification may also be appealed by the worker and depending on the new resolution that is issued, it will have some consequences or other consequences.
