En este trabajo se estudia el diferente tratamiento penológico que se aplica a los miembros de las parejas heterosexuales en las situaciones de violencia, en función de quién sea el sujeto activo y quién el pasivo, dando lugar en unos casos a supuestos de violencia de género y en otros de violencia doméstica. Para ello, compararemos las diferentes penas que contempla el Código Penal en cada uno de los delitos que se pueden cometer en la pareja. Además, nos adentraremos en el procedimiento donde destacaremos aspectos importantes de la figura del Abogado y estudiaremos, entre otras, las medidas de protección que se pueden imponer en una y otra clase de delito, las consecuencias de su quebrantamiento, así como el papel que en él desempeña el consentimiento de la víctima. Detallaremos, también, los diferentes tipos de prueba que pueden emplearse en el plenario y cómo deben practicarse para conseguir una sentencia condenatoria.

In this work we study the different penal treatment that applies to the members of heterosexual couples in situations of violence, depending on who is the active and who the passive subject, giving rise in some cases to assumptions of gender violence and other of domestic violence. To do this, we will compare the different punishment that Penal Code contemplates in each one of the crimes that can be committed in the couple. Besides, we will analyze the procedure where we will highlight important aspects of the figure of the lawyer and study, among others things, the measures of protection that can be imposed in one and another type of crime, the consequences of their breaking, as well as the important role of victim’s consent. We will also detail the different types of evidence that can be used in trial and how they should be practiced in order to obtain a conviction.
