The purpose of this paper is to analyze the bankruptcy agreement included in Title V, chapter I “On the agreement phase” of the Bankruptcy Law (articles 98 to 141 LC). An analysis of the definition is made, to know what kind of nature and what purpose the agreement pursues. Likewise, the content of the agreement is studied from the perspective of art. 100 LC, therefore, the essential content and the alternative content thereof will be observed, in addition to the legal prohibitions of the content. The processing of the proposals of the agreement is examined, but before we will distinguish between the anticipated and the ordinary proposal of the agreement, and in addition to what are the necessary requirements to be able to make the proposal. Finally, it examines the judicial authorization that will approve the proposal of the agreement and so that it produces its effects and the fulfillment or the breach of the agreement approved judicially.

El presente trabajo tiene por finalidad analizar el convenio concursal recogido en el Título V, capítulo I “De la fase de convenio” de la Ley Concursal (arts. 98 a 141 LC). Se realiza un análisis de la definición, para conocer qué tipo de naturaleza y que finalidad persigue el convenio. Asimismo, se estudia el contenido del convenio desde la perspectiva del art. 100 LC, por tanto, se observará el contenido esencial y el contenido alternativo de éste, además de las prohibiciones legales del contenido. Se examina la tramitación de las propuestas del convenio, pero antes distinguiremos entre la propuesta anticipada y la ordinaria del convenio, y además de cuáles son los requisitos necesarios para poder realizar la propuesta. Por último, se examina la autorización judicial que aprobará la propuesta del convenio y para que éste produzca sus efectos y el cumplimiento o el incumplimiento del convenio aprobado judicialmente.
