En el presente trabajo vamos a realizar un estudio tanto doctrinal como jurisprudencial del tipo básico del delito de estafa del 248.1 CP, sin entrar de una manera demasiado profunda en los tipos equiparados a la estafa del artículo 248.2 ni en las estafas agravadas del artículo 250 del CP. Para ello, vamos a exponer los antecedentes legislativos que han desembocado en el actual concepto, mucho más acertado, del delito de estafa. Continuaremos con un análisis más exhaustivo del bien jurídico protegido, entrando en los distintos conceptos que la doctrina da sobre el patrimonio. De una forma muy detallada vamos asimismo a analizar los diferentes elementos del delito de estafa (tanto los objetivos ‒engaño, error, acto de disposición patrimonial y perjuicio‒ como los subjetivos ‒dolo y ánimo de lucro‒). Mencionaremos a continuación las diferentes penas establecidas por nuestro Código Penal para el delito de estafa y, por último, abordaremos las diferentes formas imperfectas de ejecución de este delito.

In the present work we are going to carry out a doctrinal and jurisprudential study of the basic type of the crime of fraud (art. 248.1 CP), without going too deeply into the types of art. 248.2 or the aggravated fraud of article 250 of the Spanish Criminal Code. To do this, we will expose the legislative history that has led to the current, much more successful, concept of fraud. We will continue with a more exhaustive analysis of the protected legal good, entering into the different concepts that the doctrine gives about the patrimony. In a very detailed way we will analyze the different elements of the crime of fraud (both the objective ‒scam, error, act of disposition and damage‒ and the subjective ones ‒intent and profit motive‒). We will continue mentioning the different penalties established by our Criminal Code for the crime of fraud; and, finally, we will address the different imperfect forms of execution of this crime.
