Abstract

En la década de 1990, las violaciones sexuales durante los conflictos armados comenzaron a ser percibidas con mayor gravedad en el ámbito internacional. A través de la creación de los tribunales internacionales ad hoc para la Ex – Yugoslavia y Ruanda, la Corte Penal Internacional y la relación entre tortura y violación establecida en su jurisprudencia se procedió, por primera vez, al enjuiciamiento de los responsables de tales actos como autores de crímenes internacionales graves. Con razón del desarrollo del tema, este trabajo se ha realizado a través del análisis de diferentes sentencias de estos tribunales penales internacionales relacionadas con la materia.

In the 1990s, rape during armed conflicts began to be perceived more seriously in the international field. Through the creation of the ad hoc international tribunals for the former Yugoslavia and Rwanda, the International Criminal Court and the relationship between torture and rape established in its jurisprudence, for the first time, the responsible for these acts were prosecuted as authors of serious international crimes. For the development of the theme, the investigation has been executed across the analysis of different sentences of those international criminal courts related with the subject-matter.
