El presente trabajo tiene como fin principal realizar un estudio del concepto de violencia de género, así como intentar dar respuestas desde el punto de vista del Derecho Penal a este fenómeno tan presente en nuestra sociedad. Por un lado, se analiza el origen de este concepto de violencia de género y sus características propias que la diferencian de la violencia doméstica, así como su evolución al entrar en vigor la Ley Orgánica 1/2004, de 28 de diciembre. A continuación, se recogerán aquellos preceptos que regulan de algún modo actos o conductas que dan lugar a la violencia de género, su constitucionalidad y los principios de igualdad y no discriminación. Por último, se analizarán las reformas principales que la LO 1/2015 ha introducido y que afectan al tema de este trabajo, como es la agravante de género (art. 22.4 CP), y se llevará a cabo el desarrollo del concepto de quebrantamiento de condena del artículo 468.2 CP como consecuencia de incumplir alguna de las medidas del artículo 48.2 CP.

The main objective of this work is to make a study about the concept of gender violence and find the answers to fight against this type of violence nowadays, from the point of view of Criminal Law. In the one hand, it analizes the origin of gender violence, the characteristics and the differences with domestic violence, as well as the evolution of theses concepts and the entry into force of the Organic Law 1/2004, 28 December, about Protection Integral Measures against Gender Violence. Then, it studies the main articles about this type of violence and the conducts or behaviours which produce gender violence, its constitutionality and the equality and not discrimination principles. Finally, it analyze the main changes that Organic Law 1/2015, has introduced and how affect to gender violence, as aggraviting circunstance of gender (art. 22.4 CP), and it developes the breach of a sentence, as a consequence to break a prohibition in the article 48.2 CP.
