El objeto principal del presente trabajo es el análisis del sistema actual de impugnación de las estipulaciones contenidas en los contratos de préstamo hipotecarios, conocidas comúnmente como “cláusulas abusivas”, y cuya abusividad ha propiciado su declaración de nulidad gracias al control de oficio que realizan los jueces y tribunales españoles verificando la transparencia de las mencionadas cláusulas. La primera parte del trabajo expone los conceptos básicos de préstamo hipotecario y cláusula abusiva, necesarios para entender el objetivo principal del estudio y conocer así el sistema actual de impugnación de las cláusulas abusivas. La segunda parte versa sobre la explicación de los motivos que han llevado a los tribunales a declarar la nulidad de las cláusulas abusivas y también a presentar el procedimiento a seguir para alcanzar tal fin.
The main purpose of this paper is to analyse the present challenge system of the provisions in mortgage loan contracts, commonly known as “unfair terms” and whose unfairness has brought about the declaration of their nullity due to the control measures taken by Spanish judges and courts verifying the transparency of said terms. The first part of the paper explains the basic concepts of mortgage loan and unfair term, which are necessary to understand the main purpose of the study and thus to get to know the present unfair term challenge system. The second part revolves around the explanation of the reasons which have led courts to declare the nullity of unfair terms, as well as the procedure to be followed to achieve said end.
