Junto a los procedimientos tributarios de gestión, recaudación, sanción y revisión, se encuentra el procedimiento de inspección. En este procedimiento la Administración Tributaria lleva a cabo una investigación y comprobación sobre los obligados tributarios y sus situaciones tributarias. Sin embargo, el objeto de este trabajo es el de analizar cómo, en este procedimiento, las facultades de la Administración Tributaria para efectuar esa investigación y comprobación no son absolutas, sino que han de conciliarse con los derechos y garantías que ostentan todos los obligados tributarios.

The tax audit proceeding is, together with the proceedings of tax management, collection, penalties and appeal, one of the main actions that Tax Administration can develop to carry out an investigation and verification about the taxpayer and their tax situations. However, this paper aims to analyze how, in tax audit proceeding, Tax Administration’s faculties to do that investigation and verification are not absolutes. On the contrary they must reconcile administrative powers with taxpayers’ rights and guaranties.
