El presente trabajo se pretende estudiar, dentro del marco legal vigente, la responsabilidad penal de las personas jurídicas. Para lo cual, se comenzará con una introducción, donde de una forma general, se abordará la titularidad de la responsabilidad, los diferentes modelos de imputación, así como, el actual catálogo de delitos que pueden incurrir las personas jurídicas. A continuación, se procederá al estudio de las causas de exención de la responsabilidad penal, identificando a los programas de cumplimiento como novedad importante introducida en nuestro ordenamiento Jurídico a raíz de la reforma del año 2015. Posteriormente se analizará, la implementación de un programa de cumplimiento en una persona jurídica, el cual no puede realizarse sin tener en cuenta una serie de factores que permitan augurar que éste cumplirá los objetivos para los que fue creado. En esta parte del estudio, se enumeran los requisitos y principios básicos que han de seguir los modelos de prevención para ser útiles. Por último, veremos la importancia de los canales de denuncia, y dentro de éstos, la figura del delator en el actual ordenamiento jurídico español, así como su favorecimiento por parte de la jurisprudencia mediante diferentes facultades e instrumentos que ofrece el marco legislativo actual. En este sentido, se analizará la figura del delator y sus diferentes beneficios, tanto de índole sustantiva, como de índole procesal ya aplicados en el Derecho comparado.

The present work is intended to study, within the current legal framework, the criminal liability of legal persons. For which, it will begin with an introduction, where in a general way, the ownership of the responsibility will be addressed, the different models of imputation, as well as, the current catalog of crimes that may be incurred by legal persons. Next, we will proceed to the study of the causes of exemption from criminal liability, identifying the compliance programs as an important novelty introduced in our legal system as a result of the 2015 reform. Subsequently, the implementation of a compliance program in a legal entity will be analyzed, which can not be done without taking into account a series of factors that allow it to predict that it will fulfill the objectives for which it was created. In this part of the study, the basic requirements and principles that prevention models must follow to be useful are listed. Finally, we will see the importance of the channels of denunciation, and within these, the figure of the informer in the current Spanish legal system, as well as its favoring by the jurisprudence through different faculties and instruments offered by the current legislative framework. In this sense, the figure of the informer and its different benefits, both of a substantive nature and of a procedural nature already applied in comparative law, will be analyzed
