La doctrina Parot

Abstract

La doctrina Parot, consecuencia de una sentencia del Tribunal Supremo español, causó un cambio en el sistema de cálculo de la pena máxima que se puede alcanzar en España: 30 años para aquellos juzgados por el Código Penal de 1973, que se aplica a esta doctrina, dando lugar a que, presos con condenas largas, principalmente pertenecientes al grupo terrorista ETA, se les retrasara su liberación de la cárcel. A Inés del Río, miembro del grupo terrorista, se le elevó la pena de prisión desde 2008 hasta 2017, tras aplicar esta doctrina. La terrorista apeló esta decisión ante el Tribunal Europeo de Derechos Humanos, que anuló la doctrina por afectar a la Convención Europea de Derechos Humanos, concretamente a los artículos 5.1 y 7 del Tratado en vigor desde 1953.

The doctrine Parot, consequence of a judgment of the Spanish Supreme Court, caused a change in the system of calculating the maximum penalty that can be accomplished in Spain: 30 years for those tried by the Criminal Code of 1973, which is applied to this doctrine, giving rise to that prisoners with long sentences, mainly belonging to the terrorist group ETA, delayed his release from prison. To Inés del Río, member of the terrorist group, is lifted him the penalty of imprisonment from 2008 to 2017 to apply such a doctrine. The terrorist appealed this decision to the European Court of Human Rights, which annulled the doctrine by affect the European Convention on Human Rights, specifically to articles 5.1 and 7 of the Treaty in force since 1953.
