Las injurias en internet

Abstract

El presente trabajo realiza un estudio del delito de injurias en general, regulado en los arts. 208 a 210 del Código Penal, y, en concreto, cuando este delito tiene lugar a través de internet. Para ello se analiza el concepto de “injurias” y los distintos elementos del tipo, haciendo especial mención a los elementos subjetivos. Se incide en la relevancia de la publicidad en este tipo de delitos. Así mismo, se explica detalladamente la regulación procesal y cuál es el procedimiento que ha de seguir quien sea perjudicado por esta clase de comportamientos a través de internet. En el último apartado, el trabajo se centra en las nuevas tecnologías en el uso y problemas que plantean en el caso de las injurias, dado que las denuncias aumentan en las redes sociales y las peculiaridades que presentan el autor, el lugar de comisión del delito y la publicidad.

This paper makes a study of the crime of libel generally regulated in the arts. 208-210 of the Penal Code, and in particular, when this crime occurs over the Internet. For this, the concept of "defamation" and the various elements of the type, with special reference to the subjective elements is analyzed. It stresses the importance of advertising in this type of crime. It also explains in detail the procedural rules and what is the procedure to follow whoever is harmed by this kind of behavior over the Internet. In the last section, the work focuses on new technologies in the use and problems posed in the case of injuries, since the complaints increase in social networks and peculiarities that present the author, the place of the offense and advertising.
