Una de las obligaciones que la legislación vigente impone a la Administración es la de resolver los procedimientos administrativos, sin importar cuál sea la forma de iniciación de los mismos. Para hacer frente a la inactividad de la Administración que no resuelve ni notifica en el plazo establecido para ello, aparece la figura del silencio administrativo, al cual la ley confiere un sentido positivo o negativo. El estudio histórico del silencio administrativo permite comprender la evolución de esta ficción jurídica y, llegar a entender el sentido positivo o negativo del silencio.

Resolving a procedure is an obligation of the Administration, regardless of the form of the initiation of the same. If the Administration does not resolve or notify in the time established for it, then appears the figure of administrative silence. The silence is interpreted by the law in positive or negative sense. The historical study of the administrative silence allows to understand the evolution of this legal fiction and the different reason for positive and negative silence.
