La privatización en el sistema penitenciario

Abstract

La privatización de la ejecución penal no es un movimiento que surja de manera espontánea para dar solución a problemas actuales, sino, más bien, una práctica conocida en el pasado. Se trata, en fin, de la delegación de funciones tradicionalmente públicas, de gestión y administración de los centros penitenciarios, a empresas privadas con un fin lucrativo. El estudio que se presenta abarca la evolución histórica de los modos de participación del sector privado en la ejecución penitenciaria, el fundamento ideológico del que se ha dotado a estas prácticas, las estipulaciones contractuales convenidas entre los contratistas privados y el Estado y nuestras conclusiones al respecto, haciendo hincapié en la paralización del sistema privatizador.

The privatization of prisons is not new to provide solutions to current problems in the area of criminal enforcement, but is a well-known experience in the past. Privatization is to delegate functions of the state in favor of private firms operating for profit. This study covers the historical evolution of the forms of participation of the private sector on prisons and criminal ideology and policy that have supported the privatization idea. The study presented also addresses contract issues and our findings in relation to the privatization of prisons, emphasizing the paralysis of the privatized system.
