Tierras comunales indígenas en Argentina : una relectura de la desarticulación de la propiedad comunal en Jujuy en el siglo XIX

Abstract

The analysis of this article is centered in the process of confiscation and disarticulation of communal aboriginal lands during the XIX century in a specific region in Argentina: the province of Jujuy. The main reason of this paper is to determine answers from the aboriginal actors regarding legal terms and legitimation of private property that came from the government and to contribute to the knowledge of the historic processes called “liberal land reform”. Moreover, to make a reflexive exercise around the historical experiences of social systems based on “communal management” and their relation to the processes of restitution of aboriginal rights in the present

El análisis de este artículo se centra en el proceso de desamortización y desarticulación de las tierras comunales indígenas durante el siglo XIX, en una región específica de la Argentina, la provincia de Jujuy. Principalmente para determinar repuestas de los actores indígenas frente a la imposición de legalidad y legitimación de la propiedad privada que emanó del Estado, y contribuir al conocimiento de la llamada “reforma agraria liberal”. Y también para efectuar un ejercicio reflexivo en torno a los sistemas sociales basados en la “gestión comunal” y su vinculación con los procesos de restitución de derechos indígenas en el presente
