En este trabajo se analizan algunos de los argumentos más frecuentemente utilizados para negar la juridicidad y exigencia de los derechos sociales: su diferente coste económico, los deberes que implican, su carácter como reglas o principios, su naturaleza como derechos individuales o colectivos, su importancia y el papel que los jueces juegan en su garantía. Se pretende discutir estos argumentos para defender la identidad, al menos en lo que se refiere a su importancia, entre uno y otro grupo de derechos. Para ello se parte de la diferencia entre derecho y garantía.
